By accessing or using this Platform and any associated websites, applications, APIs, data feeds, or services (collectively, the "Platform"), you agree to these Terms. If you do not agree, do not use the Platform.
1. Ownership
The Platform and all content, data, methodology, software, scoring models, rankings, output formats, brand elements, and intellectual property are the exclusive property of Human Factors, LLC and its affiliates, subsidiaries, and licensors. All rights reserved.
All products and services on this Platform are protected as trade secrets, proprietary information, and/or pending patents. Unauthorized access, reproduction, or reverse engineering may result in civil and criminal liability.
2. Permitted Use
You may access and view the Platform for your own informational and business purposes. You may reference our index products in internal reporting with proper attribution. All other use requires a separate written agreement.
3. Restrictions
You may not:
- Reproduce, copy, scrape, or redistribute any data, rankings, or output
- Reverse engineer, decompile, or attempt to extract any methodology or platform technology
- Train any artificial intelligence or machine learning model using Platform data
- Create any competing index, benchmark, or intelligence product using Platform data
- Use the Platform for any unlawful purpose
4. Financial Disclaimer
Nothing on this Platform is investment advice, financial advice, or a recommendation to buy, sell, or hold any asset or financial instrument. The Platform is not a registered investment adviser, broker-dealer, exchange, or fund. Users are solely responsible for their own financial decisions.
5. Intellectual Property
Our marks, pending patents, trade secrets, and all platform technology are protected. Nothing in these Terms grants any license to any intellectual property. See the IP Notice for details.
6. Enterprise and API Access
Enterprise, institutional, and API access is governed by a separate written agreement. In any conflict, that agreement governs.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE PLATFORM.
8. Governing Law
Wyoming law governs. Disputes are resolved by binding arbitration in Cheyenne, Wyoming under AAA rules, except that either party may seek injunctive relief to protect intellectual property.
9. Modifications
We may update these Terms at any time. Continued use constitutes acceptance.
